1. Scope
These General Terms and Conditions apply to all business relationships between The StadtBoutique – Real Estate Marketing & Development (hereinafter "The StadtBoutique") and its clients.
By engaging our services, these terms are deemed accepted.
2. Scope of Services
The StadtBoutique provides services in the following areas:
- Property brokerage
- Property marketing
- Acquisition
- Advisory
- Valuation
- Letting and sale
- Home staging
- Project development
- Marketing and presentation of properties
The specific scope of services is determined by the individual mandate or agreement.
3. Brokerage Activity
All offers are made subject to availability and without obligation.
Prior sale, prior letting, or other changes are expressly reserved.
The StadtBoutique is entitled to engage suitable co-operating agents, real estate brokers, photographers, valuers, or other specialists in the performance of its services.
4. Commission
The right to commission arises in accordance with the provisions of the Austrian Real Estate Agent Act (Maklergesetz).
Commission becomes due upon the legally binding conclusion of the brokered transaction.
The amount of commission is governed by the applicable statutory provisions or by individual agreement.
If a property or prospective party introduced by the client is already known to The StadtBoutique, this must be communicated in writing without delay.
5. Payment Terms
Invoices are due for payment within 14 days of the invoice date, without deduction.
In the event of late payment, The StadtBoutique is entitled to charge statutory default interest as well as necessary reminder and collection costs.
All prices are stated in euros unless otherwise indicated. Statutory value added tax will be shown separately.
6. Liability
All property information originates from owners, authorities, or other third parties and is passed on to the best of our knowledge.
No liability can be accepted for the accuracy, completeness, or currency of such information.
The StadtBoutique is liable exclusively for damage caused by intentional or grossly negligent conduct. Liability for slight negligence, loss of profit, and indirect or consequential loss is excluded to the extent permitted by law.
7. Copyright
All exposés, photographs, texts, floor plans, visualisations, market analyses, and other materials remain the intellectual property of The StadtBoutique or the respective rights holders.
Disclosure to third parties or any use beyond the intended purpose requires prior written consent.
8. Data Protection
Personal data is processed exclusively in compliance with applicable data protection law, in particular the General Data Protection Regulation (GDPR).
Personal data is processed solely for the purposes of contract performance, client management, and compliance with statutory obligations. Further details are available in the privacy policy at www.stadtboutique.at.
9. Consumer Protection
For consumers, the mandatory provisions of the Austrian Consumer Protection Act (Konsumentenschutzgesetz) apply in addition.
Where any provision of these Terms conflicts with mandatory consumer protection legislation, the statutory rules take precedence.
10. Jurisdiction and Governing Law
Austrian law applies exclusively, excluding its conflict-of-law rules.
The place of performance is Vienna. To the extent permitted by law, the competent court in Vienna is agreed as the exclusive place of jurisdiction for all disputes.
For consumers, the statutory rules on jurisdiction apply.
11. Severability
Should any provision of these Terms be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected.
The invalid provision shall be replaced by the rule that most closely corresponds to the economic purpose of the original provision.
